Wednesday, January 18, 2012 Colonies Board Meeting Stupidity

Enough is enough - will it ever stop? Being on travel and unable to attend the recent Board Meeting, I received the summary of the Wednesday, January 18, 2012 Colonies Board Meeting Minutes and was horrified at the utter display of idiocy among the members of The Colonies community's governing body. It is 2012 and I think each time the state of things cannot get worse but, without fail, they seem to.  I should note before proceeding further I am not speaking of the Board as a whole as the summary appeared to indicate one member has emerged attempting to evoke some good changes that would also be cost effective only to be spurned by his colleagues! 

Message to Colonies Board Members:  This is NOT 1983 but 2012; Get with the times or truly be a service to The Colonies community by resigning office (all of you could take a group retreat on your own dime after resigning to Casa Lauricella’s Estate in Venice, Florida)!

For those not members of The Colonies Connection Google group (http://groups.google.com/group/thecoloniesconnection?hl=en), the summary posted Tuesday, January 24, 2012 by Colonies Social Committee Chair Allison Martin is as follows along with the incomplete Splinters From the Board Write-Up I received from a Colonies Town Hall subscriber who also stated a screenplay script was in the works for submission to cable networks like TLC and A&E for a series about an embattled residential community and the unethical activities of Management and Members of the Board (could work if a show about ‘Hoarding’ is able to garner ratings).

Board Member Peter Pollak, as stated by Dominic Basile below in his request to the Board of which to date no known response has been received, raised the issue of revoking the Smoking policy in the Administrative Building.  As captured in Allison’s summary and conspicuously missing from the Board’s Summary (the Board’s clear belief in keeping co-owners and residents informed is blatantly obvious here), the remaining six (6) Board Members voted against revoking this policy and smoking stays!  It is clear who the remaining Board members answer to – General Manager Carole Carlton!  This issue of abolishing smoking in the Administration Building and Clubhouse has been brought up countless times in the past by co-owners and residents alike.  Complaints have been made to numerous local agencies in an attempt to get the smoking banned to no avail.  The Administrative Office is the ‘face of The Colonies’ and, thus, the first place many newcomers and visitors alike get an impression of the community in which we live.  The stench of smoke in that office is not a good impression and is negatively impacting the community.

The same Board Member noted by Allison Martin who brought up revoking the smoking policy in the Administrative Building also attempted to accomplish the following only to be rebuffed by his fellow board members (hope there was some good Scotch or Wine consumed after that meeting by that Board member as it was badly needed):
  • Reducing plumbing expense costs (Building 12’s water main break was $85,000 and Building 6’s Sewer Line Rupture was $58,000) by pointing out neighboring McLean community The Commons* has never had a plumbing expense exceed $30,000 and The Colonies should look to other vendors who would be as equally responsive only to be told ‘Donnie has his list’; end result was for him to send The Commons plumbing vendor information to the office (we all know it was to humor him and it highly likely it will either go into the trash or a file never to be accessed)
    • *The neighboring Commons of McLean community has 577 1 – 4 bedroom units sizes ranging 680 – 1,677 square feet (Colonies has 457 1 - 3 bedroom units among 12 buildings sizes ranging 700 – 1,678 square feet units); the argument of comparing The Commons community to The Colonies would be comparing apples to oranges is not valid (other than fact Commons is a rental community)
  • Reducing a $475 cost to paint inside of Guardhouse by questioning it; The Colonies does have a painter and other personnel on staff and he was told the painter was busy and it was essentially questionable if other staff were ‘qualified’; he finally said in frustration he would paint it (of all the items, this one I was told took the longest to deliberate).  The $475 cost was for an outside contractor!
Many have pondered why The Colonies is so resistant to change as far as entertaining changing contractors.  Carole Carlton has allegedly been ‘on staff’ in her numerous roles for nearly 29 years and Donnie has been here for a LONG time as has Jill Smith.  Is it possible any of them could be ‘profiting’ in some form from any of these vendors which may be contributing to their reluctance to entertain the option of considering other vendors?  Anyone attending previous Colonies Board meetings would agree they are very ‘guarded’ with their contractors let alone when option of ‘bidding’ is challenged!

To give the Board of Directors some perspective as to whom they actually ‘work’ for, per the Bylaws of the Council of Co-Owners of the Colonies Condominium at McLean:
  • Article I (General) Section 3 (Membership) - An owner of a unit at the Colonies Condominium at McLean shall automatically become a member of the Council of Co-Owners upon taking title to the unit and shall remain a member for the entire period of ownership
  • Article II (Definitions) Section 2 Board or Board of Directors is the executive organ of the Council of Co-Owners comprised of those persons elected in accordance with these Bylaws.
  • Article IV (Board of Directors) Part C/Section 16 (Powers and Duties) - The Board of Directors shall manage the affairs of the Council of Co-Owners and shall have all the powers and duties necessary for the administration of the Condominium, including, but not limited to all of the powers enumerated in Section 55-79.80 of the Act, and may do all such acts and things as are not by the Declaration or these Bylaws to be done and exercised exclusively by the co-owners.
In essence, the Colonies Board of Directors works FIRST for the Council of Co-Owners and NOT for General Manager Carole Carlton (an employee and non Co-Owner).  It has been far too many years and it is time for members of the Board to turn the reins over and for Management to leave so The Colonies can start anew with a more efficient chapter of Management (the low Reserve Fund speaks for itself).  Multiple sources have told me back in the day Management and Board Members alike would discuss ‘Colonies matters’ over funded meals at the likes of Cafe Oggi or Pulcinella Ristorante but then that was when King Lauricella was at the healm!

No one appears concerned at the ongoing low reserve fund.  The Petition Candidates harped on it during last year’s election only to be rebuffed by fellow co-owners based on the end results!  The Colonies Board purports to be doing things to save money based on feedback from the October Budget Hearing.  One Co-Owner again raised the idea of a task force at the Board Meeting only to be told the Board and Finance Committee are ‘the Task Force’!  NEWS FLASH to the Board, Management and F&I Committee, there are many co-owners with a wealth of education, experience and ideas that would benefit the community so get out of your pathetic box! 

I will end with the February 2012 edition of The Colonies Crier being delivered Thursday, January 25, 2012...  I found it most humorous as February 1 is nearly a week away (Wednesday) and the January 2012 edition was delivered just two weeks previously on Thursday, January 11, 2012.  Seems like someone wanted to get their ‘slant’ of the Board Meeting out quickly in my humble opinion!!  Pretty pathetic but then that is the way Colonies Management is... pitiful with the feeble Board presently in Power too (what a team)!

Good afternoon.

Just thought I would pass along some information from last week's meeting so you all are aware of happenings in the community (tried to cover everything)...
Issues raised during Owners Forum included:
- Forming a Financial Task Force of co-owners to help address expenses, etc. that was shot down by Board saying they were in essence the 'Task Force' and many suggestions brought forward during the October 2011 Annual Budget Hearing were being explored
- How delinquencies were being addressed (liens being placed on property, etc.)
- Lights being left on in Storage Rooms; Co-owner had raised issue previously and created posters to be placed in each room and expressed them being put on back of door was not as effective as above light switch which would be last thing person would typically see when
leaving Storage Room
- Revise Clubhouse Rental Agreement to include provision about Security patroling during any/all event(s)
- Replacement of trees when removed (one co-owner mentioned replanting of real Christmas trees in previous years having occurred)


Other Information (New/Old Business):
- Colonies being sued by co-owner for $500K for slip-and-fall accident occurring 2 years ago (was thought to have then been settled by insurance company so that is again being dealt with but my take on it was there did not appear to be major concern of the issue by the Board; feeling I got is they felt it would be settled)
- Changing Smoking Policy - Killed as only 1 Board Member voted to revoke smoking policy in the Administrative Building/Office and the 6 others voted NO
- November 2011 late fee waiver Requests - 2 co-owners requests for waivers were approved because of Post Office closure and mail delay because of items still being sent there
- Issue raised of adjusting monthly statements from being sent (at co-owner option) to lower current average amount of $193/month being spent on postage (amount provided is factoring in co-owners owning multiple units, etc.) like turning off printing statement option for a
given co-owner in software (many of us were thinking like average software) and was told software was custom-built for Colonies - Additionally concern was about co-owners
having services performed in which they had a balance more than condo fee due (statement would be sent in that instance) and of course e-statements was raised
- Building 6 Sewer Line Rupture Plumbing Repairs that occurred Thanksgiving weekend totaled $55,058 and Board Member wanting to revoke the Smoking Policy in the office questioned the amount expressing it was too high as the cost of the leaking water main to Building 12 in Oct/Nov was $85,000 - it is important to note both plumbing emergencies were handled by a longstanding Colonies plumber whose bills are routinely very high in comparison to neighboring
communities; it was stated during the meeting that The Commons of McLean has never had a plumbing bill in excess of $30,000. It was also stated by Management that Donnie has his 'list' of long-time current contractors utilized by The Colonies who are responsive but plan is for that Board Member to email LCOR's The Commons at McLean's Plumbing vendor contact information to the office; bottom line is it appeared a plea to get Board and Management to consider options was made and there was much resistance expressed by Board and Management alike to entertaining any change
- December 31, 2011 Reserve Fund Balance: $320,137.07 ($146,000 decrease since 01/01/2011) - See FHA Funding information posting from I believe yesterday as this low balance is a major concern given repairs, etc. that certainly have the potential to come up with our current infrastructure
- Web Bill Payment Update - Talks with several banks occurred and our account not big enough and Colonies awaiting a proposal on alternative method from Wells Fargo that may include (ACH, Internet Checks, Check 21, Check by Phone and Check Conversion) but there is a fee/surcharge cost for these services
- Dominion Power Lighting - Colonies looking into cost saving fixture replacements in common areas; awaiting a survey with possible corrections and recommended replacements of exiting fixtures so Colonies can then build an RFP
- Approval to Paint Inside of Guardhouse sought in which an estimate by an outside contractor received was $475! Board member cited above questioned that asking why Colonies staff painter could not do task and was told he too busy with drywall; He then asked of other staff
and was told they not sure of their skillset for the task!! Board member finally said he would paint it - A co-owner present then suggested a Social Committee function be a painting party for that Board Member and I agreed and also jokingly told him not to mark up the price of the paint supplies; It was also stated the job should not take more than 2 hours and I do believe the issue was tabled
- All HVAC thermostats in residential buildings have been replaced (remote sensors and temperature set at 66 degrees during Winter months)
- 5 Nominating Committee Members are Carol Folsom, Karen Johnson but it may be Hansen, Sandy Sincavitz, Curt Johnson and last one is believed to be Karen Haynes
- Condo Assessment Fee structure - Board had previously denied co-owner request to change fee structure due to Bylaws needing to be changed, etc. and co-owner queried further requiring Colonies Counsel Robert Segan to respond
- Hearing to be scheduled in coming weeks to deny co-owner use of facilities due to non-payment of condo fees
- Dryer Lint Removal Issue - Co-owners responsible for calling contractors to address issue and contractors will be given access to roof (estimated cost is $125 - $160) and should be done I believe was stated every 2 years (I know number was not more than 3); other information about issue posted

- Dunn & Bradstreet - Correspondence received of companies being deleted/removed (3 appear to be done to date)
- Plaque at Administration Office in recently resigned Board President Sal Lauricella's name decided to recognize him for his years of service
- All Propane tanks replaced
- Co-Owner request to Change Assigned Garage Parking Space (swapping current space with where current bicycles are stored) due to size of vehicle - I believe was approved; It will revert back to original configuration should co-owner vacate/sell unit as per the Deed
- Approved request by resident to use elevator to transport dog due to medical reason (VALID only for 1 month from date of surgery)
- 2 Window Replacement requests approved
- Colonies is a member of the Community Association Institute
- Carole Carlton started her employment with The Colonies in 1983 as a Receptionist
- Social Commitee - Chair (me) going to coordinate with Board liaison to schedule next meeting; ideas have been presented for future events
- Nothing was mentioned about The Colonies website (supposedly a new one is in development) as to a go-live date, etc.

Thanks for reaching out in an attempt to keep all our residents and owners informed on what is going at The Colonies. I noticed the communication below failed to mention the topic of eliminating smoking in the common areas (office and clubhouse) which was advocated and presented for a vote by Peter Pollack. I know this topic has been presented several times in the past but I personally don't feel the community has received a response as to why all board members, aside from Peter, still support smoking in these common areas?


Can a board member please reply to the community (via The Townhall) with some insight into the inaction on this seemingly black and white matter?

The first meeting of the Colonies Board of Directors with the new Colonies President, Carol Brown, presiding took place on the frosty evening of January 18, 2012; a goodly number of hardy residents were
in attendance. The issues brought up in the Co-owners Forum included:

• Do we pursue Co-owners in arrears of condo fee payment? Yes, all Co-owners in arrears over 60 days are referred to legal counsel. Do they lose privileges to facilities such as pool, clubhouse, and tennis

• Please inform Clubhouse renters that Security has a right to patrol all functions.
• Please remind all residents to save electricity by turning off lights in Storage Rooms upon exit.
• What has been explored about changing monthly billing of condo fees? A suggested annual coupon book is not feasible since each month many Co-owners incur additional charges such as in-unit service, purchase of filters, keys, and water sensors, etc. Additionally, monthly mailing of statements has greatly helped remind owners to pay on time. Electronic Fund Transfer is not an option at this time since our bank considers us too small to provide this service. (Even the Washington Post is too small to offer this service.) Many hours have been spent exploring other options but so far all will incur a hefty charge.
• What is our tree plan? With over 300 trees on the property, the Colonies relies upon the advice of our professional arborist regarding care and placement of trees and shrubs. Trees that need to be cut down
are usually replaced whenever appropriate (that is, the original tree was not too near a building or causing a problem). Additionally, live Christmas trees have been donated after the holidays for planting as
well as other trees gifted throughout the year by residents.
• What is status of the missing storm drain cover near the Tot Lot? The new drain cover finally has been received and installed.
• What has been done to save money? The Staff is always searching for ways to cut costs as well as the Board is aggressively exploring suggestions made at the last Budget Hearing. Information on some items
currently being actively pursued is listed below.

REPORTS
President’s Report – New Colonies President, Carol Brown, warmly greeted residents and reviewed several areas the Board is pursuing:
• Foremost are several cost-saving suggestions made at the last budget Hearing. We are exploring use of Credit Unions for better rates, etc. and have explored the EFT option for condo fee payment. A company on Dominion Virginia Power’s list has been contacted to carry out an energy audit on inside and outside lighting fixtures in mid-January and make recommendations for alternative fixtures with a cost/benefit analysis. See Management Report for more information on this item.
• A Co-owner has sued the Colonies for $500,000 for an alleged injury in a slip and fall accident after a December 2009 snowstorm. The Council of Co-owners vigorously denies responsibility since the
walkways had been thoroughly cleaned. Our insurance carrier is handling our defense and is expected to cover all costs. We want to make the Co-owners aware of the lawsuit and the fact that it must be
disclosed in new sales packages.
• Dun and Bradstreet has deleted extraneous listings associated with the Colonies’ name and state there is only one legal entity – the Council of Co-owners of the Colonies Condominium at McLean.
• According to the Virginia Condo Act, section 55-79.50(C), each unit owner is responsible for keeping their dryer vent clean. Some associations mandate regular cleaning by unit owners but we are preferring to use friendly persuasion instead.
• The Board unanimously decided to honor Sal Lauricella’s 30 plus years of service to the community by dedicating the Administrative Building to him. A plaque, paid for with personal funds, will be placed on the Office.

Secretary’s Report – In addition to reporting on the five new rental leases, she observed that 20% of Colonies residents did not own computers and another significant percent seldom used their computers. Thus while the use of electronic communication is being considered whenever possible, USPS still must be used in certain specified instances where it is mandatory to reach all Co-owners and residents. She also corrected two bits of misinformation being circulated:
• Carole Carlton was hired in 1983 as a receptionist by General Manager, John Gouveia, while Bob Folsom was Colonies President. Then while April Ramey was Colonies President, Carole was promoted in 1984 to Administrative Assistant by General Manager Bill Harper who then promoted her in 1985 to Community Manager; and in 1986 April Ramey promoted her to General Manager.
• The Colonies still is a member of Community Association Institute (CAI) and has been continuously for over 3 decades.

Treasurer’s Report – As of December 32, 2011, our operating income was $2,750,024 with operating expenses totaling $2,214,303 and a reserve contribution of $425,690 making our current Reserve balance $320,137. This leaves a pre-audit to date surplus of $110,030. However, this surplus is a pre-audit number and represents accruals of cost not billed in 2011 (such as utility bills, insurance, etc.). The auditors will make adjustments when the actual costs are received and booked in January 2012. Work began on December 31, 2011 by Management to provide the auditors, Ahlberg & Company, with data and reports necessary to initiate the audit in late January 2012 of our 2011 financial records. Upon completion and certification by the auditors, a copy will be mailed to each Co-owner in the early spring.

The state requires each condo association conduct a long term Reserve study every 5 years. Miller- Dodson Associates completed our last Reserve study in 2008.

Management Report - Hearty congratulations go to 2011 Employee of the Year, Carlos Benitez, and 2011 Supervisor of the Year, Julio Flores!  Well done – we all appreciate your dedication and hard work! Also covered were:
• Four delinquent accounts have been referred to legal counsel; one foreclosed account is being sold by the bank to a new owner on January 20, 2012; and one account is trying to work out a payback plan.
• Dun & Bradstreet has emailed that after investigation, all extraneous references to supposedly other Colonies companies are being deleted.
• Thankfully, the kitchen sewer line rupture in Building 6 has been repaired. This entailed Lange Plumbing x-raying the garage slab to identify location of the numerous post tension cables so that his staff could carefully hand dig around the cables. Dangerous work indeed since severing the cables could cause serious injury or death.
• The semi-annual HVAC inspection and replacement of thermostats has been completed in all buildings.
• All propone tanks fueling the emergency generators in each building have been replaced.
• Many hours have been spent with many banks trying to set up an EFT system (and other internet-based methods of payments) for condo fees.  However all banks deem us too small to provide this service now.
• Many more hours were spent trying to identify contractors who were aware of the Dominion Virginia Power Company’s retrofit lighting reward program. Only one contractor, of several contacted, on Dominion’s own approved list was cognizant about the program and they promised to perform a survey for us in mid-January.

Social Committee Chair Report - Allison Martin reported she will schedule a meeting of the Social Committee soon to discuss new event options.

During the business meeting the Board appointed Carole Folsom, Karen Hansen, Kurt Johnson, Mary Linda Norman, and Sandy Sincavitz to the 2012 Nominating Committee; approved contracts for emergency plumbing repairs of buildings12 and 6 as well as a contract for repair of garage walls in buildings 12 and 13 and a contract for monitoring the garage slab in Building 13. The Board also approved two Co-owners requests for window replacement and ratified a request for unit modification. Because of weather conditions, the Board tabled consideration of contracts to stabilize the retaining wall behind Building 8. Additionally the Board voted to hold a Hearing regarding revocation of facilities use by a Co-owner substantially in arrears of condo fee payment and also denied the request of a Co-owner to hold a vote on changing the Condo fee structure at the annual meeting. Since according to legal counsel, it would take a 100% approval of all 459 Co-owners to change the fee structure, the Board deemed the effort to be futile and costly.
